FUNERAL/BURIAL DECLARATIONS

 

Many people do not understand the order of priority when it comes to making funeral/burial decisions. Typically, a problem only arises if an individual wants to be cremated as opposed to a traditional burial. The Mortuary Code identifies the individuals that have the decision making authority as to whether or not you are cremated, regardless of whether or not you have pre-paid for the services. However, there is a wonderful exception to this rule that individuals should be made aware of. Under the Michigan Statute, a Personal Representative named in a Will may carry out the decedents written instructions relating to the decedent’s body, funeral and burial arrangements. In order to verify that it is your wish that your Personal Representative follow through with your funeral/burial wishes, it is important that you complete a “Declaration Concerning Funeral Arrangements and Disposition of Remains“. The Declaration indicates that your statement is to be effective regardless of whether you have any other living relatives who may be otherwise entitled or have the right to make decisions provided under the laws of which you are a resident of at the time of your death.
